Professor Bennett Gershman comments on possible prosecutorial misconduct

New Orleans’ “Time-Picayune” consulted with Professor Bennett Gershman, seeking his opinion on a court case that involves claims of prosecutorial misconduct.

A Federal judge had granted an evidentiary hearing in a case against Dominick Fazzio, an executive with River Birch landfill. When granting the hearing, U.S. District Judge Ginger Berrigan cited the prosecution’s “troubled history.” The reporter spoke with Prof. Gershman regarding the likelihood that charges in the case would be dismissed.

“‘It’s a long shot,’ said Bennett Gershman, a Pace University law professor and one of the nation’s leading experts in prosecutorial misconduct. He said ‘less than a fraction of 1 percent’ of defendants who even reach this point actually succeed in getting their charges thrown out because of prosecutors’ misconduct,” reads the article written by Manuel Torres.
